James Scurlock, a 22-year-old black man, was shot and killed by Jake Gardner outside a bar in Omaha Saturday night while participating in a protest against police brutality.
Gardner was taken to Omaha police headquarters after the shooting late Saturday night and was released late Sunday night.
Many witnesses said the man who shot James Scurlock used racial slurs before firing, and that Jake Gardner had a history of racist and bigoted behavior.
No charges will be filed against Omaha bar owner who fatally shot protester, Douglas County Attorney Don Kleine says.

Hours before the Saturday night shooting, Gardner posted on Facebook about protecting his business.
”Just when you think ‘what else could 2020 throw at me?’ Then you have to pull 48 hours of military style firewatch,” he posted.
