Los Angeles County judge granted a temporary restraining order against Olivier Martinez for abusing his ex-wife, Halle Berry, as per the allegations made by the French actor. According to him, Halle Berry choked their 12-year-old son, Maceo, during a fight between them at her house.
In court documents that were initially disclosed to TMZ, 60-year-old Olivier alleges that 60-year-old Berry physically attacked their son in a violent manner on September 26. Also, he is requesting custody rights over the minor. Berry’s lawyer describes the court document as being baseless.
According to the filing, Berry entered Maceo’s room while he was playing virtual reality games and became furious because he looked “stupid” for playing. Martinez said Berry’s fiancé, musician Van Hunt, was at their place during the altercation.
It is alleged in the documents that the fight became violent as Berry hopped onto their son, grabbed him around the neck, and started strangling him. Meanwhile, she was saying, “Who is dominant now?” The filing alleges that Maceo later called his father to tell him what happened.
It is also alleged that the following day, Berry texted Olivier that she felt “terrible” about the entire episode.
According to Olivier, there had been several such episodes in the past few years in which Berry abused and assaulted their son and verbally abused her ex-husband. TMZ reported that the filing mentions an incident five years ago in which Berry attacked Olivier in the face and another one approximately ten years ago in which she threw a plate at him.
Under the temporary restraining order, Berry cannot go within 100 yards of Olivier. According to People Magazine, court documents show the restraining order applies to both Martinez and Maceo; however, the judge allowed minimal visitation to maintain contact with his mother.
Until the court hearing scheduled on October 16, Berry can meet Maceo only during court-ordered visits on two weekdays and alternate weekends. At the hearing date, the court will determine whether the order should be continued or not.
Martinez requested that the court forbid Berry from consuming alcohol or any other substance in front of her son and to get sobriety tests done with regard to visitations. As per TMZ, these were part of the restraining order. However, according to People, the judge denied the sobriety monitoring due to a lack of information.
Also, Berry and Martinez have been ordered to undergo confidential custody mediation.
According to Halle Berry’s lawyer, Marina Beck, the entire court document is entirely meritless and misleading. In her statement, she explained that there is abundant evidence and many court rulings in which Martinez repeatedly violated court orders and hindered his son’s education and therapies, and for this he was penalized. Berry is deeply saddened but determined to keep fighting for her son’s best interests.
Berry and Martinez met while filming the movie Dark Tide in 2012 and married in France in 2013. Maceo was born that October. They filed for divorce in 2015, and the case did not conclude until 2023. The settlement agreement requires Berry to pay nearly $8,000 per month in child support and to cover Maceo’s school fees and health care expenses, according to Fox News.
The issue of the minor’s custody has also arisen before. In 2024, Berry filed for sole custody of their son due to his turbulent and detrimental behavior towards Maceo’s educational and therapeutic needs.
Halle Berry was the first-ever Black woman to win the Academy Award for Best Actress for Monster’s Ball in 2002. She has a daughter, Nahla, aged 18, from her previous relationship with Gabriel Aubry.
