A woman has accused two officers from the El Paso Police Department of police brutality after getting her nose broken and her eyes swollen in front of her children following a car crash. Barnes was driving home after celebrating her daughter’s 8th birthday at Urban Air, according to her attorney. She was with her 16-year-old, 8-year-old, and 4-year-old child.

Anna Marie Barnes was involved in a single-vehicle car crash. The police incident report states Barnes fled the scene of the crash on foot with her children. When the police found her they stated she smelled like alcohol. The police report also states when El Paso police officers tried to handcuff Barnes she began to back away and pulled her arms away to break from the officer’s grip. That’s when the officers used their legs to trip Barnes causing her to fall straight on her back.

Barnes was charged with driving while intoxicated with children under 15 years of age and resisting arrest, search or transport.

Attorneys representing the 33-year-old, claim Barnes’ nose was broken by one of the El Paso police officers.

“He broke the bones under my nose and my nose. It’s been painful. Especially with that cold front. It just feels like somebody slammed me into a wall,” said Barnes. Barnes’ lawyer also claims that one of the officers blocked the view from El Paso Fire Department EMS at the scene as the other officer was whaling on Barnes.

Barnes’ attorney stated that a doctor determined Barnes was “clinically sober” and gave clear answers.
