In a deeply distressing case, the family of a 9-year-old girl has taken legal action against Boston Public Schools, filing a lawsuit in Suffolk Superior Court after the young student was allegedly assaulted and raped multiple times by another 11-year-old student on a Boston school bus, according to CBS News.
The lawsuit, spearheaded by Morgan & Morgan, extends its claims to include the City of Boston, Match Charter School, and a Transdev bus driver and monitor as defendants.
According to the lawsuit, the horrifying incidents unfolded over seven months during the 2022-2023 school year while the girl attended Match Charter Public School in Hyde Park.
The document states that the sexual assaults occurred on various dates during the ride home from school, just a few feet away from the bus monitor and the bus driver.
The legal representation from Morgan & Morgan emphasizes the traumatic toll on the young girl, forcing her to leave school early due to fears of further physical or social consequences.
The lawyer states, “Our client will experience a childhood haunted by trauma and flashbacks, and we will do everything in our power to hold the defendants accountable and prevent anything like this from happening to another child in our city.”
The lawsuit further alleges that the Transdev bus driver and monitor should have been aware of the repeated and ongoing sexual abuse, asserting they had a duty to identify, intervene, report the abuse, and take reasonable steps to prevent its recurrence.
Shockingly, the legal document claims that Transdev and/or its co-defendants “negligently, recklessly, and/or intentionally lost or destroyed video footage” from the bus.
