Kaylee Gain’s Attacker Avoids Adult Charges After Bullying Evidence Reveals Gain Initiated Fight, Judge Rules

A St. Louis judge ruled on Wednesday that the 15-year-old girl accused of severely beating her 16-year-old classmate, Kaylee Gain, into a coma will not face adult charges. This decision follows an extensive review of the circumstances surrounding the violent March altercation outside Hazelwood East High School.

Judge Alicia Martin, who presided over the case, visited the accused girl’s home and examined her school records before deciding to keep the case in juvenile court. The suspect, whose identity remains undisclosed due to her age, was involved in a physical confrontation that left Gain hospitalized for several months.

Disturbing footage from the incident shows the suspect climbing on top of Gain and repeatedly slamming her head into the pavement. However, Greg Smith, the defense attorney for the 15-year-old, argued in court that Gain had a history of aggressive behavior and had initiated the fight by striking the younger girl first. Smith presented evidence that Gain had been previously suspended from school for fighting, painting a complex picture of the events leading up to the assault.

The family of the suspect has reported receiving multiple racial threats since the incident, emphasizing that the altercation stemmed from self-defense rather than premeditated aggression.

After months of intensive medical care, Gain has returned home. She undergoes physical and speech therapy several times a week and faces ongoing challenges, including short-term memory loss and an upcoming surgery to repair a section of her skull. Bryan Kaemmerer, the Gain family’s lawyer, shared that she continues to grapple with the trauma, fear, and pain resulting from the attack.

Despite their ordeal, the Gain family expressed their respect for the judicial process. Kaemmerer stated that the family would honor the judge’s decision to handle the case within the juvenile system, regardless of their personal feelings on the matter.
